Research activities outline |
My main interest of study is on international law-making process. By taking the examples from Antarctic Treaty system and multilateral environmental agreements (MEAs), I have been studying the legal issues involved in the international legal regime building, especially from the perspective of sources of international law and from the “compliance-pull” perspective. I plan to broaden the perspective by including dispute settlement procedure and liability issues. On the Antarctic Treaty system, my current study in on the newly established “liability” Annex to the Madrid Protocol on the environmental protection. I plan to publish an article (in English) on this issue in a book edited by Professor KOMORI of Hokkaido University. My previous works includes: Establishment of the Secretariat of the Antarctic Treaty, CRAMRA law-making process and its legitimacy, CCAMLR law-making process and its legitimacy, and the ATCM as law-making forum. They are all written in Japanese. On the MEAs, most of my recent works relate to the Basel Convention on the Control of Transboundary Movement of Hazardous Wastes. One reason for this is that I was elected as a Compliance Committee member in 2002 and served as a rapportuer until 2006. I have written both in English and Japanese on the negotiation process and the legal significance of the Basel Compliance mechanism. In a forthcoming book edited by Professors SHIMADA and HAYASHI, I will discuss the theoretical and practical relationship between the Basel Compliance mechanism and the Basel dispute settlement procedures.
